Summary of Draft Amendments to Food Regulations 2025 – Implications for Cocoa & Chocolate Stakeholders
Region: APAC - Malaysia
Status: Final Regulation - not yet effective
Background
The Ministry of Health Malaysia has conducted a series of online public consultations in 2025 (Seranta Awam Atas Talian 2025) on proposed amendments to subsidiary legislation under the Food Act 1983. The amendments are introduced in four batches and cover food safety assurance, product standards, nutrition and health claims, labelling requirements, and pesticide residue limits.
Several of the proposed changes have direct relevance to cocoa beans, cocoa products, and chocolate manufacturing and trade, including imports, bulk handling, and finished products placed on the Malaysian market.
Key Areas Relevant to Cocoa & Chocolate
Cocoa and Chocolate Product Standards
Proposed amendments to Schedule XII-A of the Food Regulations 1985 include revisions affecting cocoa and cocoa products.
Implications:
Potential changes to compositional requirements (e.g. cocoa solids, permitted ingredients).
Need for manufacturers to reassess existing formulations, especially for compound chocolate and flavoured cocoa products.
Possible alignment challenges for products manufactured for both domestic and export markets.
Comparison: Current vs Proposed Requirements (Cocoa Focus)
Area | Current Framework | Proposed 2025 Amendments | Key Impact |

CAA Preliminary Observations
For cocoa and chocolate stakeholders, the proposed amendments signal:
Stronger regulatory oversight across the cocoa value chain
Increased emphasis on upstream compliance and traceability
Tighter controls on product composition, claims, and imports
Greater need for early regulatory planning and internal compliance review
CAA encourages members to closely monitor the finalization and gazettement of these amendments and to begin preliminary gap assessments where relevant.
Members with specific concerns or requests for technical clarification may contact the CAA Secretariat.
